When subscribing to the Booze AI App and continuing to use the Booze AI App, you agree to be bound by all terms and conditions.

These Terms and Conditions sets forth the Legal Disclaimer and Privacy Policy for the BoozeAI mobile application (“App”), developed and operated by BoozeAI Pty Ltd (“BoozeAI,” “we,” “us,” or “our”). This policy applies to users in the United States, Australia, Canada, the European Union, and other jurisdictions where the App is used.
1. General Disclaimer
BoozeAI provides an estimate of Blood Alcohol Concentration (BAC) based on user inputs, voice analysis, and behavioral tasks.
Important Notice:
The BAC results provided by BoozeAI are estimates only and should not be considered definitive.
BAC estimates are intended for informational and entertainment purposes only and are not a substitute for police-grade breathalysers, blood tests, or other legally recognized BAC measurement tools.
BoozeAI is not a legally recognised or quality certified software application for the testing of BAC. It is an educational App to help inform you of the risks of consuming alcohol, the impact on your body, your reaction time and decision-making ability. It is an educational tool which can provide an estimate of your BAC based on data which has been collected from clinical trials, user testing and your personal information. You cannot rely on the estimates for legal purposes or for the purposes of determining your fitness to drive.
The App can only make an estimate of the original User’s BAC. Another person cannot use your App with your User information to perform an accurate estimate of BAC.
The results of the App and its reliability and general accuracy depend on the quality and accuracy user inputs, that is the information you give it. False or incorrect information could dramatically impact the ability of the App to provide meaningful results to you.
Safe Drinking Policy
BoozeAI emphasizes the following principles when using the App:
You must not drive after consuming ANY amount of alcohol.
Regardless of whether your estimated BAC is within the legal limit in your region, or even if you have consumed a small amount of alcohol, you must not drive or operate machinery after drinking any amount of alcohol due to the risk of physical and mental impairment and potential accidents that could occur because of additional reaction breaking distance.Impairment risks:
Even within the legal limit, alcohol consumption can significantly impair reaction time, judgment, and motor skills which can result in additional breaking distance when driving a vehicle at speed. By using the App, you acknowledge and understand the impairment risk of any amount of alcohol consumption and the risk of additional breaking distance associated with slow reaction time and reduced cognitive and decision-making ability.By using BoozeAI, you agree that all decisions regarding alcohol consumption and associated risks remain your sole responsibility.
2. Limitations of Liability
No Warranty
BoozeAI provides the App "as is" and makes no representations or warranties of any kind, express or implied, regarding:
The accuracy, completeness, reliability, or suitability of the BAC estimates.
The fitness of the App for any specific purpose.
Limitation of Liability
To the maximum extent permitted under applicable law, BoozeAI Pty Ltd, its affiliates, employees, and agents shall not be liable for any damages, including but not limited to:
Loss of life or injury.
Property damage.
Financial losses or legal penalties resulting from reliance on the App’s outputs.
This limitation applies regardless of the theory of liability, whether in contract, tort, negligence, or otherwise.
3. Privacy Policy
3.1 Data Collection and Usage
To provide accurate BAC estimates and improve algorithmic performance, BoozeAI collects the following data:
Voice data: Audio recordings of voice.
Task performance data: Interactions with the App’s behavioral assessments.
Device information: Model, operating system, and app usage metrics.
User-provided data: Inputs such as age, weight, gender, and drinking habits.
3.2 Purpose of Data Collection
To calculate BAC estimates.
To refine the App's algorithms and improve accuracy.
To enhance user experience through analytics and feature updates.
3.3 Data Security
BoozeAI employs industry-standard measures, including encryption, firewalls, and secure storage systems, to safeguard user data against unauthorized access, misuse, or disclosure.
3.4 Data Sharing
No sale of personal information: BoozeAI does not sell user data to third parties.
Aggregated and anonymized data: May be shared for research, statistical analysis, commercial or marketing purposes.
Third-party processors: Data may be shared with trusted third-party services for operational purposes, in compliance with applicable laws.
Data shared with you: Your data may be shared with you via email, sms and messenger services or via notifications. These message services may not be secure and may result in your data becoming publicly visible to others.
Data shared by you: the App contains a sharing functionality, whereby you can share your BAC results and personal information with friends. This data may become publicly visible and by using the App you agree to the potential public visibility of such personal information you share with others.
4. User Rights

Users have the following rights regarding their personal data, depending on jurisdiction:
Access: Obtain a copy of the data collected about you.
Correction: Request correction of inaccurate or incomplete data.
Erasure: Request deletion of your data, subject to legal retention obligations.
Restriction: Limit how your data is processed.
Objection: Opt out of specific data processing practices, including marketing.

5. Not Intended for Medical or Legal Use
The App’s estimates are not medical devices and are not approved by any therapeutic authority or regulatory body. BoozeAI is not a substitute for professional medical advice, diagnosis, or treatment regarding your alcohol use or any other medical purpose. Additionally, the App is not designed for use as evidence in legal proceedings.
6. Subscription Payment & Fees
By subscribing to the App, you agree to pay the fees as described on the payment page which may include discounts or special offers to you. If you select a monthly payment plan, you agree to the immediate billing of the monthly fee and then the automatic deduction of the monthly fees each month until cancelation by you. You can cancel your monthly subscription anytime with 30 days notice by emailing info@booze-ai.com. If you select an annual payment plan, you agree to the immediate billing of your account for the annual fee which may include discounts or special offers to you and then the automatic renewal of your agreed annual fee until cancellation by you. You can cancel your annual subscription anytime with 30 days notice by emailing info@booze-ai.com.
7. Updates to This Policy
BoozeAI reserves the right to modify this Legal Disclaimer and Privacy Policy at any time. Changes will be communicated via the App, and your continued use signifies acceptance of the updated terms.
